Puffemistic/Puff Tastics terms of service

The Terms of Service govern the sale of personalized digital illustrations created by Puff Tastic/Puffemistic.Any order implies the full acceptance of these Terms of Service by the client.Puff Tastic/Puffemistic retains the right to deny any service without explanation. Puff Tastic/Puffemistic wishes to express that they will not accept commissions NSFW in nature, will not accept commissions with ai generated/assisted character sheets or reference materials and will not accept commissions requesting artwork drawn in a style I am unknown to produce creations in.1. DISCLAIMERBy placing an order with Puffemistic/Puff Tastic, the client automatically accepts the following conditions. Please read these Terms of Service carefully.Puffemistic/Puff Tastic strictly prohibits the use of their illustrations for artificial intelligence (AI) purposes, tracing or the creation of NFTs (Non-Fungible Tokens).If there is any confusion surrounding this, Please contact me via instagram (puffemistic) or via email ([email protected])2. USER AGREEMENTBy ordering, the client agrees that they have read this terms of service in full and that they accept the conditions of the TOS.The client agrees that commissioned artwork is to be used for personal/private use only unless agreed otherwise during commission process.The client agrees that they will only submit quality references with clear explanation and understands that if this standard is not met, commissions may be rejected (exceptions for character reference sheets).The client agrees to crediting Puffemistic/Puff Tastic when reposting/using artwork publically.3. PAYMENTClient agrees to pay order amount upfront, client agrees that they are responsible for any/all currency conversion fees that may incur.Payment must be confirmed by Puffemistic/Puff Tastic before the creation process begins. The order will not start until it has been confirmed the transaction was successful.Payment must be made within 30 days of invoice being produced, penalties may be issued if payment is made late up to 10% of the invoice amount.4. REFUNDSRefunds may be issued to a client if work has not begun, after sketch has been produced, a partial refund may be issued. Once sketch is approved, refunds may not be issued.5. REVISIONS + FEEDBACKClients will regularly receive updates on their artwork when new milestones are met, clients are okay to enquire about the status of an artwork as long as this is not excessive or approached in a rude way.Clients must respond to updates with clear and concise feedback if unhappy with the current state of an artwork.Clients have the right to request minor changes, if large scale changes are requested, an additional fee may be charged to compensate for both the time and effort that revision may take.Puffemistic/Puff Tastic is not responsible for unsatisfactory results, as there will be plenty opportunity for issues to be communicated during the process.Clients may not change their mind about large details after they have been approved unless prepared to pay additional fees.6. DELIVERYArtwork will be delivered in PNG form via a download link/email depending on clients preferences. If neither of these suit, please contact me about alternative methods of delivery (eg: discord, twitter etc).Delivery timeframes are given as estimates in the description of each commission advertisement. These are subject to change based on factors such as time of year, workload and commission complexity.All commission delivery times will generally stick to a maximum wait time of 3 months after payment. This may be extended if the work commissioned is extremely complicated, however if I believe this to be the case for your commission this will be discussed at some point well before the 3 month mark is met.I will also aim to give each client an individual estimated completion date at least once. If this is not discussed with you, do not be afraid to approach me to ask me about it.8. INTELLECTUAL PROPERTY RIGHTSPuffemistic/Puff Tastic retains all copyrights to the illustrations. I do not offer the option for you to pay additionally for copyright ownership transfer.The works are provided for personal, non-commercial use unless a commercial use agreement has been established. This will incur additional fees.Any commercial use (reproduction, sale, etc.) of the work requires explicit agreement with Puffemistic/Puff Tastic.9. COMMERCIAL USEIf client wishes to use any artwork for commercial use, this must be discussed with myself in advance. The minimum fee for this being +100% of the base price.Commercial uses include, but are not limited to, reproduction and public or private sale of the work.Puffemistic/Puff Tastic reserves the right to adjust the fee based on the complexity and details of the order.Puffemistic/Puff Tastic allows the printing of any artwork commissioned for personal use ONLY.10. CONFIDENTIALITY AND PERSONAL DATAThe personal information provided by the client during the order (name, first name, email address, billing address, payment information) is strictly confidential and will only be used for the production and delivery of the illustration and for invoicing.Puffemistic/Puff Tastic wholeheartedly committs to never sharing/selling this information to third parties.11. PUFFEMISTIC/PUFF TASTICS RIGHT TO USEPuffemistic/Puff Tastic reserves the right to use any commissioned artwork for the purpose of posting on social media or including artwork in a portfolio. This is non negotiable.12. LIABILITYPuffemistic/Puff Tastic commits to the production of a high-quality artwork that meets the client's specifications to the best of their ability as agreed upon when the order is placed. However, Puffemistic/Puff Tastic cannot be held liable for indirect damages, financial losses, or other issues arising from the use of the delivered artwork.The client is held responsible for the appropriate use of the illustration according to the agreed terms.13. UNEXPECTED EVENTSIn the off chance an unexpected event occurs which completely disables Puffemistic/Puff Tastic from completing any commissioned artwork, Puffemistic/Puff Tastic cannot be held liable for no delivery. In the off chance something like this occurs, each client will be contacted and a solution to this will be discussed ranging from partial/full refund to a rescheduled expected deadline which will always be as soon as reasonably possible.14. DERIVATIVE RIGHTSAny creation of derivative products or adaptation of the work into other media (books, merchandising, video games, etc.) must be agreed upon in writing with Puffemistic/Puff Tastic, and will incur additional fees agreed upon in advance.15. DISPUTE RESOLUTION• In case of a dispute, the client and Puffemistic/Puff Tastic agree to seek an amicable settlement before taking any legal action.16. ACCEPTANCEClients who are 18+ are held legally responsible when agreeing to these terms of service, any clients who happen to be under 18 years of age must have a legal guardian who agrees to these terms of service on their behalf.By commissioning Puffemistic/Puff Tastic, you agree and accept to abide by the terms of service layed out and agree that you have thoroughly read and understood the terms of service.

My Commission process !!

I understand some people may be neurodivergent, anxious or just prefer to know what to expect when they pay for a product, if this describes you this may provide you some comfort and help lift some stress you may feel while waiting for me to complete your commission. :)If you require reasonable adjustments, such as more frequent updates or help understanding how to navigate vgen, please make this known to me, I am more than happy to help!Step 1. You request a serviceOnce you have requested to work with me, I will review your request and decide if I wish to deny or accept your commission! If my status currently sits at "waitlist" I may not review your commission for a while, if I have not put on my social media when the current waitlist period ends, please do not be afraid to message me on vgen or any of my social medias to ask!!Step 2. I accept your requestOnce I have accepted your request I will send out an invoice, once that is paid, work begins! If I feel I need more info from you I may message you before I start work to make sure I completely understand what you'd like me to do!Step 3. I begin workI should have something jotted down/have a rough sketch completed within 1-4 days after payment, I will aim to get back to a client to provide them progress once a rough is complete, if I fail to do this and you want to know my progress, please do just drop me a DM and I will share with you what I have currently completed!Step 4. UpdatesThroughout the commission process I will send you progress each milestone I hit: rough sketch, sketch, lineart and render updates, how frequently you recieve updates truly just depends on my irl life workload, commission workload and the complexity of your commission. I will ask you to approve each step along the way however significant changes may incur fees (Please read TOS for more info). There will likely be longer intervals of silence from me if you've ordered a more complex commission as they take so much more time! Feel free at any point to ask me how things are going especially during the render stage when things are much more likely to go quiet. :)Step 5. Commission complete!When I've completed your commission, I will first check you are 100% happy with it before officially sending the file off to you, you will be able to download these files in "my requests" on your vgen profile and will also get an email with the downloadable files! I will then thank you for working with me and ask you if you could kindly leave me a review, I will also leave a review for you as a customer which helps other artists make an informed decision as to if they should take you on as a client! This can also be found in the "my requests" section. If you have a little extra money in your pocket and you feel I did exceptionally, you also have the option to leave me a "boost" which is essentially just a tip!I hope this helps you understand how I work as an artist and is useful/reassuring. :)
